General Terms and Conditions of Sale
The following General Terms and Conditions govern the offer and sale of merchandise on our website www.poeticaworld.com. Any reference to “we” or “our” in these General Terms and Conditions of Sale means The Poetic Filter, a sole proprietorship, registered in Geneva, Switzerland.

1. Formation of the contract
1.1 Upon submitting an order on www.poeticaworld.com, you enter into a contract with POETICA.
1.2.By clicking on “purchase”, you are placing a binding order for the items in your shopping cart. Once you have submitted your order, we shall send you an e-mail confirming the receipt of your order. The binding contract is formed upon the dispatch of the items ordered.
2. Shipping
2.1.For regular orders to be shipped within the EU, the product(s) ordered shall be shipped within the days needed to produce your item, from receipt of our confirmation of your order, so long as the item(s) ordered is available at the time of order.
2.2. Price of shipping varies from 15-25 euros within Switzerland and the EU.
2.3.Outside of the EU, prices are 15-25 euros.
2.4.For special orders whereby the desired product(s) is sold out, you may place a “wish”. If we are able to create the desired item for you, you shall receive an e-mail asking you to confirm your “wish” and inviting you to proceed to payment. For such special orders, the product(s) shall be shipped both within and outside the EU, within 5-7 business days from the confirmation of the order.
2.5.Should an item you ordered become unavailable, we shall let you know as soon as possible, and if the payment has already been made, we shall refund you via your payment method, without undue delay.
3. Prices and shipping costs
3.1.All prices on www.thepoeticfilter.com are given in Euros (EUR).
3.2.The prices given on the website on the date the order is placed shall apply. The indicated prices are final and shall include any applicable delivery charge and value added tax (VAT) at the applicable legal rate.
4. PAYMENT
We solely accept payments by credit card through our website.
5. RETURNS / ECHANGES
5.1. The Poetic Filter merchandise is handmade in Italy and is of the highest quality. From the fabrics used to the highly supervised craftsmanship. All items are quality-controlled and checked for any faults, as well as weighted before they are dispatched to you.
5.2. However, should you have a concern with a faulty or damaged item, or for any other reason, please follow the process detailed here below in order to return or exchange our products.
Time limit and eligibility of the products for return or exchange
5.3. Returns and exchanges are accepted within 14 calendar days from the day you received your order. Returns postmarked more than 14 days after you received your order are ineligible for a refund.
5.4. Returns and/or exchanges will only be accepted for new, unused items, along with the original packaging including dust bag and box. Returns and/or exchanges of products damaged or soiled post-delivery will not be accepted and will be returned to you at your expense.
Refunds and costs
5.5 Items that were on-sale at the time of purchase will not be refunded.
5.6 A refund will only be granted upon the return of new, unused items, in their original dust-bags.
5.7 If your order has been sent to a destination within SWITZERLAND, all sales taxes that we have collected shall be refunded.
5.8 Outside SWITZERLAND, we will not refund customs duties and sales taxes, however, you may be able to recover such duties and taxes by contacting your local customs bureau directly.
5.9 All costs of returns and/or exchanges are borne by you. Please note that both national and international shipping, duties and taxes are not refunded in the event of a return or an exchange.
5.10 However, should the item be returned to us due to damage or faults that occurred prior to delivery, we will cover the cost of returning your order to us in order for it to be repaired, replaced or refunded, provided that you return the item within a 7-day limit detailed in section 5.3.
5.11 In the case of an exchange, should you wish to exchange the product you originally purchased with another of a higher price, please note that you will pay the difference. Should the new product you wish to exchange your original item with cost less, you will gain store credit for the difference in price.
The process for returns and exchanges
5.12 In order to return an item, start the process by e-mailing us at help@poeticaworld,com within 3 calendar days of receipt of your purchase.
5.13 If you wish to exchange an item, e-mail us at the same address within 2 calendar days of receipt of your order. Within such e-mail, given that our products are limited editions, let us know which product you would like us to put on hold for you so that it does not sell out while you return the original product back to us.
5.14 Following a confirmation e-mail from us acknowledging your request for return or exchange, send the item to the following address:

5.15 Should you receive the incorrect model or color of the item you ordered and e-mail us in this regard within 2 calendar days of receipt of the product, we shall organize the return and send the correct ordered item without undue delay. We shall bear the relevant shipping charges solely in this case.
5.16 You bear the responsibility for shipping your returned item back to the address indicated in section 5.14. It is highly recommended to carefully send us the tracking number associated with your return.
5.17 In order return/echange a product, please follow the instructions here below:
a) Fill out return shipping label;
b) Put the item(s) in a secure box in their original packaging;
c) Write the return address as indicated in section 5.14 on the box;
d) Send the box with the shipping carrier indicated by The Poetic Filter by e-mail.
5.18 Processing of the return or exchange will take approximately 3-4 business days as of receipt of the returned merchandise. Following such processing, your refund shall be executed within 5-10 business days.
5.19 You will receive an e-mail notification once the return has been processed and your refund has been credited to the same credit card used to make the purchase.
6. Cancellation policy
6.1. Should you wish to cancel an order, e-mail us to this effect at help@poeticaworld,com within 24 hours of the submission of your order.
6.2. Please note that once dispatched, an order cannot be cancelled nor refused at the time of receipt and “returned to sender”. In such a case, you will have to accept the package and follow the return procedure detailed in section 5.
7. Customer privacy
In order to perform our services, we process your personal information in accordance with our Privacy Policy, found on www.poeticaworld.com
8. Governing law and dispute settlement
8.1. These General Terms and Conditions of Sale and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Switzerland, without regard to the conflict of law provisions therein.
8.2. The courts of Geneva, Switzerland will have exclusive jurisdiction over any claim arising from or related to the use of our website, although we retain the right to bring proceedings against you for breach of these General Terms and Conditions of Sale in your country of residence or any other relevant country.
9. Amendments and updates
The General Terms and Conditions of Sale may be amended from time to time. Any changes are effective as of the date of publication on www.thepoeticfilter.com and will apply to any new orders you place following the date of publication.
